By accessing or using The Gold Index Club website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service. We reserve the right to update these Terms at any time; continued use after changes constitutes acceptance.
2. Description of Service
The Gold Index Club is a subscription-based service that provides trade signal ideas, market commentary, and educational content focused on XAUUSD (gold) and US30 (Dow Jones) instruments. Signals and commentary are shared via a private WhatsApp group and/or the members area of our website. The Service is intended for educational and informational purposes only.

The content provided by The Gold Index Club, including all trade signals, market analysis, and commentary, is for educational purposes only and does not constitute financial advice, investment advice, or a recommendation to buy or sell any financial instrument. You should consult a qualified, licensed financial advisor before making any trading or investment decisions.
FSCA Disclaimer
Percival and The Gold Index Club are not licensed financial service providers and are not registered with the Financial Sector Conduct Authority (FSCA) of South Africa. We do not hold a Category I or Category II Financial Services Provider (FSP) licence. The Service does not constitute the rendering of financial services as defined in the Financial Advisory and Intermediary Services Act (FAIS), 2002.
3. Eligibility
You must be at least 18 years of age to use this Service. By subscribing, you confirm that you are of legal age and have the legal capacity to enter into a binding agreement.
4. Subscription and Billing
- The Service is offered at a subscription price of R150 per month.
- Payments are processed securely via Paystack.
- Your subscription will automatically renew each month on your billing date unless cancelled.
- You are responsible for ensuring your payment method is valid and has sufficient funds.
5. Cancellation Policy
- You may cancel your subscription at any time through your account dashboard or by contacting us.
- Cancellation takes effect at the end of your current billing cycle. You will retain access until that date.
- No refunds are provided for partial months or unused portions of your subscription.
- There are no lock-in contracts or cancellation fees.
6. User Responsibilities
As a subscriber, you agree to:
- Use the Service for personal, non-commercial purposes only
- Not redistribute, resell, or share trade signals or membership content with non-members
- Not screenshot or forward private group content to public channels or social media
- Take full responsibility for your own trading decisions and risk management
- Maintain the confidentiality of your account credentials
7. Prohibited Use
You may not use the Service to:
- Engage in any unlawful activity
- Impersonate The Gold Index Club or its representatives
- Reverse-engineer, copy, or create derivative works based on our content or systems
- Harass, abuse, or disrupt other members in the group
- Use automated bots or scrapers to access our content
8. Intellectual Property
All content provided through the Service, including trade signals, analysis, website design, and branding, is the intellectual property of The Gold Index Club and is protected by applicable copyright laws. You may not reproduce, distribute, or create derivative works without prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Gold Index Club, its owner (Percival), and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service.
- We do not guarantee the accuracy, completeness, or timeliness of any trade signal or market analysis.
- Trading financial instruments carries substantial risk of loss. You acknowledge that you may lose some or all of your invested capital.
- Past performance of signals is not indicative of future results.
- Your use of the Service and any trading decisions you make are entirely at your own risk.
10. Indemnification
You agree to indemnify and hold harmless The Gold Index Club and its owner from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your trading activities, or your breach of these Terms.
11. Data Handling and Privacy
We collect and process personal data in accordance with the Protection of Personal Information Act (POPIA). For full details on what data we collect, how it is used, and your rights, please refer to our Privacy Policy.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
